According to the prosecution, Nikolai Samokhval made an obscene comment towards Lukashenko in the presence of his wife and bailiffs, who came to their apartment to ask questions about their neighbors. The statement was allegedly obscene and humiliated the honor and dignity of Lukashenko, and also assessed him negatively.

Nikolai Vasilyevich did not admit guilt at trial. He said he was at home with his wife when two girls in uniform came to ask about their neighbors. When they were leaving, through his emotions he said the phrase indicated in the expert’s conclusions, but in no way related it to Lukashenko - it referred to the need to change the system as a whole. The prosecution noted that during pre-trial proceedings Samokhval admitted that the phrase was directed towards Lukashenko. It was recorded on the bailiff's video recorder and formed the basis of the charges.
It is worth noting that the expert was unable to determine whether Lukashenko was the object of the negative assessment, since this cannot be done using linguistic methods.
